Scope

These terms apply to the use of RailTools BEAM (the tool) by the licensee named in the offer or order and by its users.

Licence

  • The licence is granted to the licensee for the period, the number of users and the report quota agreed in the offer or order.
  • Accounts are personal. Passwords must not be shared.
  • Demo accounts serve evaluation only: they work on the demo line, for a limited number of days and projects, and create no reports.

Use of the results

  • The tool supports the engineer; it does not replace the engineer. Every result must be checked by a qualified engineer, who remains responsible for the design and its verification.
  • A result is valid only for the input given and for the standards and catalogue data of the version shown on the report.
  • A report is authentic only if its number can be verified on the verification page.

Liability

  • [Lawyer: limitation of liability as far as Swiss law permits (Art. 100 OR), for example no liability for slight negligence and for indirect or consequential damage, and a cap such as the licence fees of the last 12 months.]
  • [Proposal: vdp Software Tools GmbH corrects errors in the tool reported to it within a reasonable time and informs the licensees whose registered reports may be affected.]
